1. Acceptance of terms
By creating an account with ForexDNA ("the Service"), operated by ForexDNA ("we", "us", "our"), you ("the User") agree to be bound by these Terms & Conditions in full. If you do not agree, do not create an account or use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.
2. Nature of the Service
ForexDNA provides an automated trade-execution service that places foreign-exchange trades on the User's linked brokerage account. The Service is a technology platform. We are not a broker, investment adviser, portfolio manager, or financial institution. We do not hold client funds, execute trades on our own account on behalf of users, or provide personalised financial advice.
3. Risk disclosure
Foreign-exchange trading carries a high level of risk and may not be suitable for all investors. You could lose some or all of your deposited capital. Leveraged products amplify both gains and losses. Past performance, backtested results, and live-account figures displayed on the platform are not indicative or guaranteed of future results. You should not invest money you cannot afford to lose.
4. No financial advice
Nothing on this website or within the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All information is provided for general informational and educational purposes only. You are solely responsible for evaluating whether any trade, strategy, or investment is appropriate for you.
5. User eligibility and obligations
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. You must provide accurate, truthful information during registration. You are responsible for maintaining the confidentiality of your account credentials. You must comply with all applicable laws in your jurisdiction.
6. Brokerage accounts
The User's brokerage account is held with a third-party broker, not with ForexDNA. We have no control over the broker's execution, pricing, spreads, slippage, platform uptime, or policies. You are bound by the broker's own terms and conditions. We are not responsible for any actions or failures of the broker.
7. Strategy and performance
We do not guarantee any specific level of return, profit, or performance. All performance figures shown on the platform are historical or derived from trading on ForexDNA's own live account and are shown for transparency purposes only. The strategy may be modified, paused, or discontinued at our sole discretion and without prior notice.
8. Limitation of liability
To the fullest extent permitted by law, ForexDNA and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or in connection with your use of the Service. Our total liability shall not exceed the amount you have paid to us (if any) in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless ForexDNA and its affiliates from and against any claims, liabilities, damages, and costs arising from your use of the Service, your breach of these terms, your violation of any law, or any trading losses on your brokerage account.
10. Intellectual property
All content, code, algorithms, strategies, designs, trademarks, and other intellectual property associated with ForexDNA are our exclusive property. You may not copy, reverse-engineer, decompile, or attempt to derive the source code or logic of any trading strategy or system used by the Service.
11. Account suspension and termination
We may suspend or terminate your account at any time, with or without notice, if we believe you have breached these terms, engaged in fraudulent activity, or if we discontinue the Service. On termination your access ends immediately; any open positions remain on your broker account for you to manage.
12. Data and privacy
We collect and process personal data, including your broker credentials, as described in our Privacy Policy. By using the Service you consent to that processing.
13. Service availability
We do not guarantee uninterrupted or error-free operation of the Service. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any trading losses resulting from service interruptions.
14. Third-party links and services
The Service may contain links to or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party service.
15. Force majeure
We shall not be liable for any failure or delay in performing our obligations where such failure results from circumstances beyond our reasonable control, including natural disasters, war, pandemics, government actions, or cyberattacks.
16. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. Governing law and jurisdiction
These terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
